Terms & Conditions — Fivestar Valeting & Detailing

1. Agreement to Our Terms

These Terms and Conditions (“Terms”) are a legally binding agreement between you (“you”, “the user”, “the customer”) and Fivestar Valeting & Detailing (“we,” “us,” or “our”).

These Terms govern your use of our website www.fivestarvaleting.net (the "Website"), our Vehicle detailing services (“Services”), and our digital products, including all online courses, programs, and guides (“Digital Products”).

By accessing our Website, booking our Services, or purchasing our Digital Products, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you are prohibited from using our Website and services and must stop immediately.

These Terms must be read alongside our Privacy Policy and Cookie Policy, which are also integral parts of our agreement with you.

2. Who Can Use Our Services

To use our Website and/or purchase our Services and Digital Products, you must be at least 18 years of age, or the legal age of majority in your jurisdiction, and possess the legal authority and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website or our services if doing so is prohibited in your country or under any law applicable to you.

3. Vehicle Detailing Services

  • A. Bookings & Booking Fees: A 10% booking fee is required to confirm your booking. This is non-refundable and non-transferable. If you cancel or fail to attend, the fee is forfeited. If we must cancel your booking, we will reschedule you at the earliest opportunity.

  • B. Personal Belongings: It is your sole responsibility to remove all personal belongings from your vehicle before the service begins. Fivestar Valeting & Detailing shall not be held liable for any loss or damage to items left in the vehicle.

  • C. Vehicle Condition: We reserve the right to assess the vehicle upon arrival. If it requires significantly more work than described, we will discuss any potential additional charges with you before proceeding.

  • D. Access to Utilities: We require access to an electrical supply for our extension leads to efficiently carry out work on your vehicle, a water supply is also required and preferred, although we do have the capacity to carry water to work upon a maximum of 2 vehicles.

  • E. Vehicle Assessment: A full vehicle assessment will be completed prior to commencing any work. We will note any existing cosmetic damage on both the interior and exterior of the vehicle.

  • F. Heavy Soiling Surcharge: If the vehicle's interior is heavily soiled with mud, pet hair, mould, vomit, or anything beyond standard dirt, an additional charge will be applied. Please notify us when booking if any of these conditions are applicable to avoid unexpected charges.

  • G. Accepted Payment Methods: We accept all major payment methods, including Card, BACs (Bank Transfer), or Cash.

  • H. Payment Due: Full payment for services rendered is due upon completion of the job.

  • I. Invoicing & Late Payment: Any invoices will be emailed directly to you. Payments are required to be made within 7 working days of the invoice date. Failure to make payment within this period will result in a 10% charge being applied for each outstanding week.

  • J. Rescheduling: If we have to reschedule your booking due to adverse weather conditions (which can impact detailing quality) or any unforeseen emergencies on our part, your booking fee will be transferred to a re-booked appointment.

  • K. Client Cancellations: Any cancellations made by the client that do not meet our criteria, or without sufficient prior notification, may result in the full booking charge being due and payable. Criteria for cancellations if within 24 hours of booking – booking will be rescheduled at no cost. If within 12 hours of booking – booking fee will be lost and rescheduled with another booking fee payable. If within 2 hours of booking – booking will be charged at full cost and client will be liable for full payment.

  • L. Full Insurance: We are fully insured to work on all types of vehicles, ensuring your vehicle is in the safest possible hands.

  • M. Location Restrictions: Please be aware that our insurance does not cover us to work on roadside locations or in public car parks. We must have a safe driveway or a secure, shared drive to carry out our services. It is your responsibility to ensure a suitable location is available.

  • N. Alternative Arrangements: Please discuss any concerns regarding location requirements with us at the time of booking. Alternative arrangements can be made where possible to accommodate your needs safely and legally.

  • O. Experience & Standards: With over 21 years of dedicated experience, we assure you your vehicle will be treated with the utmost care and left to the highest of standards.

  • P. While we exercise extreme care, Fivestar Valeting & Detailing cannot be held responsible for unforeseen damage or pre-existing conditions that become apparent during the detailing process. Our liability for any claim shall not exceed the cost of the service provided.

4. Digital Products: Online Courses & Guides

  • A. The Commercial Terms: When you buy a Digital Product, you agree that: (i) you are responsible for reading the full item listing before committing to buy; and (ii) you enter into a legally binding contract to purchase an item when you complete the checkout payment process. All prices are listed on the website, and we reserve the right to change them at any time and to correct any inadvertent pricing errors.

  • B. Access and License: Upon purchase, you are granted a single, non-exclusive, non-transferable license to access and use the Digital Product for your personal, non-commercial use. Access is provided via the members' area of our Website. You are responsible for keeping your account login details confidential.

  • C. REFUND POLICY FOR DIGITAL PRODUCTS: All sales of Digital Products are final. Due to the immediate, irrevocable, and digital nature of this content, we enforce a strict NO-REFUND POLICY. This is clearly communicated on our sales pages before purchase. By completing your purchase, you explicitly acknowledge and agree to this policy.

5. Ownership of Intellectual Property

The Service and all materials therein, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all Intellectual Property Rights related thereto, are the exclusive property of Fivestar Valeting & Detailing. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publish, adapt, edit or create derivative works thereof.

6. Right to Suspend or Cancel User Account

We may permanently or temporarily terminate or suspend your access to the members' area and Digital Products without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law, particularly rules regarding the distribution of intellectual property.

6. Indemnification

You agree to indemnify and hold Fivestar Valeting & Detailing harmless from any demands, loss, liability, claims, or expenses (including attorneys’ fees), made against us by any third party due to, or arising out of, or in connection with your use of the Website or any of the services or products offered on the Website.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Fivestar Valeting & Detailing be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Fivestar Valeting & Detailing assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

8. Right to Change Offering & Modify Terms

  • Change of Offering: We may, without prior notice, change the Services or Digital Products; stop providing them or any of their features; or create limits for them.

  • Modification of Terms: We reserve the right to modify these Terms from time to time at our sole discretion. You should review this page periodically. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms.

9. Governing Law & Dispute Resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto shall be governed by, construed under, and enforced in all respects solely and exclusively in accordance with the internal substantive laws of England and Wales. All such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Manchester, UK.

10. Promotional Communications

By providing your contact details, you agree to receive from time to time promotional messages and materials from us, by mail, email, or any other contact form you may provide us with. If you don't want to receive such promotional materials or notices – please just notify us at any time or use the "unsubscribe" link in our emails.
